Registering Ownership of Roatan Real Estate with the Honduran GovernmentHaving a Honduran attorney involved in your Honduras real estate transaction is vital. Not all Honduras land has been properly registered with the government to secure the right to ownership. A reputable Honduras lawyer will perform a title search and make sure the property ownership is properly recorded with a legal document which is referred to as a public document in Honduras. That public document will either be an Esritura Publica or Dominio Pleno, depending on the status of the property at the time of transfer. An Escritura Publica is used if the property was already registered prior to the sale of the real estate. If the property was not registered previously, a Dominio Pleno is issued after a judge concludes that the seller is the rightful owner. The judge verifies ownership by consulting with surrounding property owners and documents. A notice of the issuance of a Dominio Pleno is posted for 30 days to prior to the document becoming final. A Domino Pleno has as much legal authority as an Escritura Publica in defining ownership. The public document will have a square stamp that shows the court's registry number. Your real estate purchase must have a survey with meets and bounds defined before the public documents will be registered. The government charges a real estate transfer tax. The transfer tax and closing costs cost the buyer about 5% of the selling price. A number of realtors here on Roatan charge sellers commissions of 10%.
